With the help of ESFTUG, the court deemed the teacher's dismissal illegal and ordered the school to pay compensation!
The two-year legal dispute between teacher Mariam Zedelashvili and Public School No. 151 ended with the teacher's victory. Her interests were defended by Giorgi Kosashvili, the Head of the Legal Department of the Educators and Scientists Free Trade Union of Georgia (ESFTUG).
The court deemed the dismissal order illegal and ordered the school to pay compensation for compulsory idleness and compensation.
The case began in December 2022, when the director of School 151 dismissed the teacher after imposing disciplinary sanctions. Mariam Zedelashvili decided to pursue a legal battle. The process started in 2023. The court of first instance did not accept the school's arguments and considered the claimant's evidence credible. Moreover, during the mediation meetings held parallel to the process, the school categorically refused to settle, as it was convinced of its own righteousness.
The school appealed the decision to the Court of Appeals, however, shortly after the start of the process, when it became clear that the decision would not change, the school's representative withdrew the lawsuit. With this fact, the decision of the court of first instance entered into force.
According to Giorgi Kosashvili: "This is yet another proof that, through the court process, on the part of ESFTUG , it is possible to effectively protect the rights of teachers. The court confirmed that the teacher's dismissal order was illegal, which creates a basis for the prevention of similar violations in the future."
By the court's decision, the school will pay Mariam Zedelashvili both compensation and reimbursement for compulsory idleness. SPTU thanks the judge for the fair decision.
