Another trial was successfully completed in Sagarejo Magistrate Court. Judge Giorgi Bukhrashvili satisfied the law requests of illegally released teacher - Natia Chincharauli - reinstatement and compensation of compulsory remuneration.

In the court, the interests of the fired teacher were protected by Ucha Bakuradze, the head of the ESFTUG Legal Department. As a result of the two pending sessions in favor of the teacher, the decision was announced on May 13, 2019, on restoration of the position of the teacher and the compensation for compulsory remuneration.

Ms. Natia was dismissed from the position of the teacher on September 10, 2018 and this decision was based on the "agreement between the parties."

The opressed teacher applied to the ESFTUG Legal Department for assistance. Megi Sakandelidze, lawyer of the legal department, prepared the lawsuit of Natia Chincharauli. During the process the employer changed the position and stated that the ground for dismissal was not the agreement of the parties, but the expiration of the contract. The point is that the agreements of the parties did not actually take place and naturally the school could not confirm the circumstances.

ESFTUG thanks the judge Giorgi Bukhrashvili for making a fair decision!

Natia Chincharauli worked at Gombori Public School for 3 years and during this period she has always been honestly fulfilling her duties, never having any remarks or reprimand against her.

Initially, the parties signed a one-year and two-year labor agreement, which was considered indefinitely, as under Article 6 of the Organic Law - Labor Code of Georgia, if a labor contract was signed for more than 30 months or if the labor relations continued Labor agreements twice or more in consecutive terms And its duration exceeds 30 months, it shall be deemed to be a permanent labor agreement.

ESFTUG continues to protect the interests of other teachers in the Courts of Common Pleas of Georgia and believe in their successful completion.
