Successfully completed another trial in court. As a result, the Judge Tamar Lakerbaia satisfied the demands of Giuli Lagidze, Maia Burduli and Ketevan Arziani – the teachers who were illegally dismissed from the Georgian National Youth Palace. In particular, she found the dismissal orders illegal and obliged the employer to pay compensation.

Teachers were dismissed by orders dated June 30, 2017, pursuant to Article 37 (1) (f) of the Labor Code:

"Noncompliance of the employee's qualifications or professional skills with the position/job to be performed"

The release was preceded by an interview where the teachers' qualifications and professional skills had not actually been checked, and the employer had previously intended to terminate employment contracts with Giuli Lagidze, Maya Burduli and Ketevan Arziani.

Several trials were held in which the interests of the dismissed teachers were defended by Grigol Bakuradze, Head of the Legal Department of the ESFTUG. The employer failed to substantiate compliance with the law on dismissal orders, and in respect of Giuli Lagidze, he also acknowledged that the real basis of the termination of the employment contract was the retirement age, which directly constituted discrimination.

After lengthy trials, on November 27, 2019, the court upheld a ruling that partially upheld the plaintiffs' claims - namely, the dismissal orders were declared invalid and the employer was ordered to pay compensation. As for the reinstatement of the position, this part of the demand was rejected, as there are no such positions anymore. If the plaintiffs wish, the ESFTUG would assist them in appealing this part of the court's decision to the court of second instance.

Currently, ESFTUG continues to advocate for other teachers in the Common Courts of Georgia and look forward to their successful completion!
